Is it illegal to work on Labor Day?

Labor Day, celebrated on the first Monday in September, is a federal holiday dedicated to honoring the contributions of American workers. But as many employees gear up for barbecues, other wonder: Is it illegal to work on Labor Day? The short answer is, no. It’s not illegal for most private sector employees to work on Labor Day. There are, however, several hiccups involved and this is where you must understand your rights.

Do most people get off on Labor Day?

We can only imagine how you must be feeling if you’re left wondering, “Do most people get off on Labor Day?”.

A significant majority of Americans enjoy Labor Day as a paid holiday. Roughly 78% of civilian workers receive paid holidays, including Labor Day, with union members receiving even higher rates than 85%.

That said, not everyone gets the day off! Over 40% of businesses require at least some staff to work on Labor Day. This is the sad reality of working in retail, hospitality, healthcare and some customer service sectors.

We can only imagine how you must be feeling if you’re left wondering, “Do most people get off on Labor Day?”.

Essential services like hospitals, restaurants and even delivery operations rarely shut down on holidays. This means millions of Americans are laboring even on Labor Day.

If you’re in one of these sectors, you might find yourself working today.

Do you have to work on Labor Day?

The answer to this question depends on your employer, job type and ultimately, your employment agreement. Federal law does not mandate that private employers provide time off (paid or unpaid!) for Labor Day or any other federal holiday.

So, do you have to work on Labor Day? The answer is yes! Your boss can schedule you to work on Labor Day without violating any laws, unless your contract, union rules or company policy states otherwise. For federal employees, the rules sightly differ. Federal employees get the day off, but if required to work, they may receive premium pay.

When it comes to the private sector, there’s no such guarantee. States like Rhode Island and Massachusetts have laws around holiday pay. However, these laws don’t prohibit working on Labor Day.

Your rights, if you’re working on Labor Day

Working on Labor Day isn’t that uncommon, and it’s perfectly legal for employers to require it.

Many companies offer incentives such as overtime pay or holiday premiums to encourage staff to work on Labor Day.

Under Title VII of the Civil Rights Act, employers must reasonably accommodate religious observances unless it causes undue hardship. However, Labor Day isn’t a religious holiday, so this rule rarely applies.

Can you be forced to work on Labor Day?

Yes. Employers can force you to work on Labor Day without any legal repercussions. Refusing to work on Labor Day could lead to disciplinary action, including termination, especially in at-will employment states. If you contract guarantees that day off, or if you’re covered by a collective bargaining agreement, you may expect stronger protections.

Labor Day comes as a symbol of rest and recognition for millions of American workers. While it’s not illegal to work on Labor Day, employees should negotiate holiday policies during hiring or advocate for better workplace benefits.
